Judgments And Contingency







When you can't enforce judgments yourself, and you can't afford to hire a lawyer by the hour to attempt to recover a judgment, and you can't sell your judgment for more than a few pennies on the dollar; the right option is to find a contingency recovery solution. Contingency judgment recovery is future payment. You do not get paid money up front, you are paid in the future when and if, money gets recovered from your debtor. Usually, there's no costs to the judgment creditor. Most often, it is a long time before you get paid.

One contingency judgment recovery option is to assign your judgment to a judgment recovery specialist. However, there are other options that do not require one to assign their judgment. Two examples are a contingency lawyer or a collection agency. My articles are my opinions and are not, legal advice. I'm a judgment referral expert, and not an attorney. There is a large variation in the collection companies which collect judgments. The majority of collection agencies are old-school, and use only the telephone and letters, to try to pesterdebtors into paying. Some collection agencies also use lawyers, and look for debtor assets to have the Sheriff levy. They work just like judgment recovery specialists do, except you don't have to assign the judgment to them. Most often, if you have a contingency professional recovering your judgment, and nothing is happening, it is because your judgment debtor hasn't any assets showing.

If a collection company is run and owned by attorneys, sometimes they aren't allowed to pay court costs or Sheriff expenses. That means even when they make you pay nothing up front, and nothing per hour, you might need to pay certain court fees, which are modest if compared with hourly lawyer expenses.

When you retain a contingency recovery lawyer, there are two kinds of lesser-known expenses you could have to pay. Under some situations and states, you may have to pay some court costs. Also, some lawyers have Quantum Meruit contract clauses that specify when you fire that attorney, you might owe them for the time and expenses they invested to try to recover your judgment, even when no progress has been made.

Most people would prefer to get paid cash up-front for their judgments. Yet, for every real judgment buyer, there are a thousand times more contingency recovery professionals. And, if you don't have to assign a judgment, there isn't that much difference, because money up front judgment buyers must do their due diligence, that can take weeks; and some contingency collection companies promise action, or they will return the judgment in 15 days.

If the debtor is broke, money up front judgment buyers will pay you almost nothing, and most often no contingency collection solutionwill get you paid either. When your judgment debtor is average, a judgment buyer may pay you only a tiny percentage of the value listed on the judgment, and a future pay contingency expert will probably collect some or all of your judgment money eventually.

If your judgment debtor is wealthy, cash judgment buyers will take a few weeks to carefully research your judgment debtor circumstances, as wealthy debtors can retain attorneys to thwart recovery attempts, or conceal their available assets. Future pay contingency professional may collect money in weeks, when your judgment debtor has lots of assets showing. So when your judgment debtor is wealthy, you get cash fast, no matter what recovery option you choose.

With future payment contingency basis recovery solutions, you don't need to assign your judgment. This means you keep your judgment, and pay nothing up front, and usually nothing at all. You don't spend any time or go to court, and get most or half of whatever may get collected.

When you want money up-front, shopping a judgment doesn't work well because actual judgment buyers all pay around the same. They always pay for judgments based on what the judgment debtor's situation is. Shopping your $5,000 judgment to ten judgment buyers, might eventually bring a range of offers from $241 to $266.

With contingency recoveries, you can shop around, however there's an issue because often you get what you pay for. Someone who charges thirty percent to enforce your judgment may not try as much as a solution charging you fifty percent. Often, the best contingency rates come from enforcers that are not too good at recovering judgments. They might attempt to get as many judgments as possible, and do not do much on judgments who do not look really easy.

Usually, if good judgment collection agencies charge you thirty percent, they require you to pay some court costs, which isn't always their idea, it is often as per law. The fifty percent ones most often absorb the expenses. If your debtor is rich, a judgment broker knows the best solutions. Contingency collection with a good collection agency or lawyer, is how most judgments really are recovered. When your judgment debtor has available assets, you will probably get cash fast.
