Mediation and Divorce Finding a Balance

Mediation and divorce are two words no one likes to think about. But the fact remains over half of all marriages end up in divorce. Whether or not you and your partner can get through mediation and divorce and find a way to reach an amicable agreement may depend on the skills of a divorce mediator. Emotions run high during a divorce, and you and your partner may not be able to separate your emotions from the situation in order to make rational decisions based on logic and not your heart. This is where an experienced divorce mediator can help you. Mediation and divorce go hand in hand, and may be the right path for you and your partner.

Protect Your Interests

If you go to court and to through litigation to obtain your divorce without mediation the court will decide such important things as child custody, child support, and visitation. The judge will decide how you will divide up your assets and real estate. Many times this is done without the input of the parties involved. With mediation and divorce all of these things are decided before you go before the judge. Mediation gives you a chance to come to an agreement on all of the factors involved. You can look out after your own interests. Many people bring a lawyer to mediation, but it is not necessary. A qualified mediator creates a level playing field for both partners, and guides them into making mutually beneficial decisions in mediation and divorce proceedings.

Learn to Work Together

One of the most beneficial aspects of meditation and divorce is learning to communicate. A breakdown in communication may have been one of the factors leading to your divorce. If your spouse was abusive you may be hesitant to go into mediation. This is understandable, but many times the abused spouse feels empowered by getting on a level playing field with their partner. The mediator controls the meeting and keeps things from getting out of hand. In order for meditation to be successful both parties must come into it with a desire to come to an agreement, and with an open mind. While you might not start out with that mindset, as the mediation process progresses your mediator will help you learn new ways to communicate and work out an agreement. This can help avoid future conflicts, and if you have children may help you share custody in a more peaceful manner.

Mediation and divorce is about finding balance. You have to balance what you want out of your divorce settlement and what your partner wants. An impartial third party mediator will guide you in this process. Mediation and divorce are stressful, but with the right mediator you can get through this hard time in your life with your dignity intact. Mediation and divorce isn't for everyone, but if you and your partner come into it with an open mind and an honest desire to work together, mediation and divorce can work.
